Acceptance of Terms

By accessing or using the Talevio application ("App") or website ("Site"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of a minor child, you represent that you are the child's parent or legal guardian and that you accept these Terms on the child's behalf.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create a parent account. Children under 18 may only use the Service through a child account created and managed by their parent or legal guardian.

Description of Service

Talevio is a creative storytelling platform that allows children to draw characters using a digital canvas and enables parents to generate AI-powered story videos featuring those characters. The Service includes:

A digital drawing canvas where children can create characters
AI-powered story generation that uses children's drawings to produce narrated video stories
A credit-based system for purchasing story generations
Family account management tools for parents
Story viewing and playback capabilities

Talevio is designed as a safe, ad-free environment for children. There are no social features, no messaging, and no ability for children to interact with other users.

User Accounts

Parent Accounts

Parent accounts are created using a valid email address with passwordless authentication (magic link or one-time password). As a parent account holder, you are responsible for:

Maintaining the security of your account and email address
All activity that occurs under your account, including actions taken by child accounts you create
Ensuring that the information you provide is accurate and up to date
Supervising your children's use of the Service as you see fit

Child Accounts

Child accounts are created exclusively by parents or legal guardians. Children log in using a username and password set by the parent. Child accounts have limited permissions — they can create and manage drawings, and view completed stories, but cannot generate stories, make purchases, or access account settings.

Talevio is not a substitute for parental supervision. Parents are responsible for determining the appropriateness of the Service for their children and for monitoring their children's use as they deem necessary.

Acceptable Use

You agree not to use the Service to:

Create, upload, or transmit content that is obscene, offensive, hateful, or inappropriate for children
Attempt to circumvent any security measures or access controls
Use the Service for any illegal purpose or in violation of any applicable laws
Interfere with or disrupt the Service or servers connected to the Service
Attempt to reverse engineer, decompile, or disassemble any part of the Service
Use automated tools, bots, or scripts to access the Service without our prior written consent
Create accounts using false or misleading information
Share your account credentials with unauthorized third parties
Use the Service to generate content that promotes violence, discrimination, or harm

We reserve the right to suspend or terminate accounts that violate these acceptable use guidelines without prior notice or refund.

User-Generated Content

Your drawings belong to you. When children create drawings using Talevio, the original artwork remains the property of the user (or their parent/guardian). However, by using the Service, you grant Talevio a limited, non-exclusive, worldwide, royalty-free license to:

Store and display the drawings within the App for you and your family
Process the drawings through our AI systems to generate story content
Create derivative works (story scenes, animations) based on the drawings for the purpose of delivering the story generation service

This license exists solely to enable us to provide the Service. We will not use your drawings for marketing, advertising, or any purpose unrelated to delivering the Service to you, unless we obtain your explicit written consent.

AI-generated stories are produced using your drawings and selections as input. The resulting stories are provided to you as part of the Service. You may view and replay stories within the App. The AI-generated narrative content, scene images, and audio are produced by our AI systems and are licensed to you for personal, non-commercial use.

Intellectual Property

The Talevio name, logo, app design, user interface, underlying technology, AI models, and all other intellectual property associated with the Service are owned by Talevio and are protected by copyright, trademark, and other intellectual property laws.

You may not:

Copy, modify, or distribute the Service or any part thereof
Use the Talevio name, logo, or branding without our prior written consent
Create derivative works based on the Service (excluding your own drawings and the stories generated for you)
Remove any copyright, trademark, or proprietary notices from the Service

Credits & Payments

Talevio uses a credit-based system for story generation. Credits are purchased by parents through in-app purchases or the website.

Credit purchases are final and non-refundable, except as required by applicable law or as outlined in the refund policies of the app store through which the purchase was made
Credits are consumed when a parent initiates story generation for a child
Credits have no cash value and cannot be transferred, traded, or exchanged
Unused credits do not expire as long as your account remains active
If a story generation fails due to a system error on our end, the credits for that generation will be refunded to your account balance
Credit prices are subject to change; any price changes will not affect credits already purchased

All payments are processed by third-party payment providers. We do not store your credit card or payment details. By making a purchase, you agree to the payment provider's terms of service.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI-Generated Content

Stories, images, and audio are generated by artificial intelligence systems. While we implement safeguards to ensure age-appropriate content, we cannot guarantee that all AI-generated content will be free from errors, inaccuracies, or unexpected output. We do not warrant:

The quality, accuracy, or suitability of any AI-generated story content
That AI-generated content will meet your specific expectations or preferences
That the Service will be uninterrupted, error-free, or available at all times
That generated stories will perfectly represent children's drawings

Parents should review AI-generated stories to ensure they are satisfied with the content before allowing children to view them.

Limitation of Liability

To the maximum extent permitted by applicable law, Talevio, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, or goodwill
Service interruptions or data loss
Unauthorized access to or alteration of your data
Any content generated by the AI system
Any conduct or content of any third party on the Service

In no event shall our total liability exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Talevio and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service or any violation of these Terms
Content you create or submit through the Service
Your violation of any applicable law or regulation
Your violation of any rights of a third party

Termination

You may terminate your account at any time through the in-app settings or by contacting us at support@talevio.com. Upon termination:

Your account and all associated child accounts will be deactivated
All personal data, drawings, characters, and stories will be permanently deleted within 30 days
Any remaining unused credits will be forfeited and are non-refundable
Your license to use the Service will immediately cease

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent activity, or extended periods of inactivity.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Talevio operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the App at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
